fact is aa and alcoholism has nothing to do with sexuality. blaming the fellowship for drinking is like blaming the accident on the car and not the drunk driver behind the wheel.

prolly didn't expect this to be part of the consequences of your actions, but the facts are, what youre experiencing is possible consequences.

in my opinion if you are facing a felony with this 4th charge then I would take the deal.

but if you have money this is a strong case you just need a strong DUI lawyer that does these cases on a daily ! the best one in your city.

30 months of interlocking is not bad! where I live 2 duis got me 3 year no licence and 3 years interlocking !!!

Also a interlocking device might be the best thing for you. I know it helped me and saved me from further trouble!

if this is the fifth time around and you are willing to get sober you just can't afford another dui you need interlocking!! it will only save you in the long run

Been through the DUI thing too many times.
That's not a bad deal and I would take it.

Your lawyer is correct with his facts --
lose in court and probably expect much worse.
In California they would be hanging you out to dry.

Will be my 5th total dui if found guilty, but only 3rd offense.

I was convicted of two DUI's. Got super lucky to have one thrown out.

I know first hand the not caught:caught ratio......

Just curious as to why the car was in someone's name? Does that mean you can't legally have a vehicle under your name? Not judging just wondering. Personally I would take the plea deal and be done with it.

I bought the car not only to have something when I did get my license back but to also have a second vehicle easy on gas for my roommate/bff to drive me and her to school. The insurance and car was in her name because I can't get insurance offered to me most places and the ones that would was way more than I could ever afford.

You've said you went out to lunch, is there any chance of getting the camera footage from the restaurant/bars car park to prove you weren't the one driving?

Wow. That sucks. As others said, your attorney can issue a subpoena to the driver and her sister. You might not know where she is now but the law can find her. I'm not sure where you live, but where I am there are many red lights with cameras to catch speeders. Maybe your attorney could get footage from one of those. Similarly, if you drove through town or stopped for gas, some businesses have security cameras that could prove your friend was the one driving. (I've been watching too many Dateline shows....lol) I feel for you, being gay is challenging enough but it must be difficult to open up in an AA meeting. When I went to rehab (non AA based) in October, one of the "guests" was gay and no one thought anything of it. I guess it depends on how progressive (or not) your area is. Good luck with everything.

Yeah I hope to one day find support that is 100% open to all. I am not saying that I can't be thick skinned and still go to mtgs around here and hold back from talking about me and my husband or the fact that part of my drinking problem is a direct cause of the small mindedness and uneducated people I have grew up around in the non progressive region of the United States I live in.

Read both of your posts and still can't determine who was driving the vehicle when "we" totaled the car. That's a pretty important detail. If you were driving, take the plea deal. If you weren't driving, take it to trial and make sure you have your ducks in a row.

I'm really confused about this thread. You have four DUI and you still have a license? Or you will still have one with an interlock?
