No I do not have any prior criminal history. My lawyer said 3 years probation and no jail time so I don't understand why I even need this done. The DA is not trying to jail time. I just have a habit of thinking the absolute worst is going to happen. If the Judge and DA are not trying to jail time then why do I need a PSI?

Prodigy - if your lawyer said no jail time, then it's no jail time It's SO easy to wind ourselves up researching on the internet and not so easy to reassure ourselves. I did the same thing recently in relation to a heath matter. x

The thing is he said at the end "The PO could still recommend jail time" I asked him if I was for sure not going and he told me as a Lawyer he could not say I was absolutely not going to go. That is why I am worried, but I will try and stay positive.

He has to cover his back though, but I still think they're just trying to get you to stay on track. My worry is, that your subconscious is building it up to more than it is, so it's an excuse to drink. What do you think?

Prodigy, you need to find a way to relax and get your mind off of this. If you have no prior history the chance of going to jail is very, very slim. Jails are overcrowded and you have proven your commitment to your sobriety, continue to do so. You remind me of my daughter, from zero to doom in 0.1 seconds :-) Hang in there, it will be okay.

I don't know if you are alcoholic ??

keep having those signed

that you have been attending meetings

are serious about your sobriety

the courts will hardly never
send someone to jail who has been attending many meetings
and not re-offended (picked up a new charge)

as I kind of stated before
many who have not a clue
will re-offend before their next court date
I see these poor souls often in the court system

you don't seem to be one of these Prodigy
so
count your blessings and move on with a sober life
because
if alcoholic ??
and we return to the drink
in time we will be back into some kind of trouble caused by drinking

I don't know if you are alcoholic ??
all I really know is
I have proven to myself that
I can not drink without losing control

I am definitely an alcoholic, and I think that this event might be what I need for life long sobriety. I am attending meetings everyday, got a sponsor, home group, and I am seeing a therapist weekly. I really am trying.

Man can I relate- I just dealt with an arbitration for something and despite essentially no chance of anything going wrong I convinced myself I would be sued, broke, homeless and somehow end up in jail lol.

Not that its good or bad but just saying I know plenty of people with a lot of DUI's who never did jail time- its very very difficult to get jail time for a first DUI- honestly with a lawyer essentially impossible unless you were like telling everyone at every point in the process to F off which you obviously aren't doing.

Your biggest problem right now is probably going to be staying motivated when the heat is off. I haven't been in AA that long but have already begun to see the pattern of "OMG my life is over I'm getting sober this time for real" followed up by "OMG I'm so glad its all over with" followed by "Eh, it wasn't so bad that cop was really just a jerk" followed by drinking. It can be tough to stay motivated when you feel great.

A friend of mine was facing 9 years in prison for his 6th DUI. Prior to his court date, he went into inpatient rehab for 30 days and went to AA meetings every day when he got out. At the sentencing, they just gave him probation and no jail time! He has been sober for 3 years now.
