Question Question: Do medical professionals have a legal obligation to report addicts?

I am asking this for a family member.

Family member is supposed to stay clean for 30 days before going into a detox program, supposedly for alcohol, and then on to a long-term treatment program. It's come to our attention she is still using (heroin), which is a violation of her probation and could send her back to jail.

She can NOT be using where she is now. If she were to go to an emergency room for withdrawal, would the hospital need to tell her P.O.??

The short answer is no. Medical professionals have enough to do without being law enforcement officials. They have to inform authorities if a threat is being made to harm another person or themselves. The stuff that has to be reported are communicable diseases and other health threats, and then different county and state ordinances come into play, and sometimes the CDC. But not illegal drugs, unless they are privy to the commission of a crime, like a robbery, to get them.

However ... If the terms of her probation included a consent to release medical information and the PO requested such information .... then the answer might be yes...

But first things first.... She must withdraw safely and get recovered ... Shame that she has to suffer, you know... Maybe jail is not the worst thing that could happen... She could die.
