Curious as to how the law works exspecially since marijuana has become legal in California starting January 1 2018 and pregnant women are yawing it more frequently through out there pregnancy. What happens if a new born child test positive for thc? Will the child be taken by CPS or will it be okay as long as no other drugs come up positive in baby or mother

That sounds like a question where you would need legal information.

My suggestion would be to call CPS in your area and find out what their policy regarding marijuana is.

Don't know the answer, but can't imagine why an infant would routinely be tested for THC. This would be a specific test and not something done as a routine blood panel.

Definitely a question you'd have to ask an attorney or someone from CPS in your area. Having said that I think it would be ill advised to smoke anything during pregnancy.

I don’t think the legality of it really makes a difference. Alcohol is legal but if it’s found in your newborn’s system, there is going to be an issue.
