DUI Fees & State Programs: More harmful than Helpful?
OK what would you propose? Do you not agree with the premise that making a DUI painful lowers DUI deaths?
Haha: okay, I get the point. But my point was that a drunken pedestrian is going to probably do little more damage than bumping into you. Maybe a drunken cyclist could hurt you but you will probably not have more than bumps and scratches. But getting hit by a two ton vehicle driven by an intoxicated driver can kill you.
That, would haunt a lot of people the rest of their lives.
I wasn't making any personal attack - just confused.
The bit about the punch up and saying something you shouldn't and someone offering to do something sexually illegal....all a bit much for me....I have enough grey hair already
I should leave this thread.
Good luck

When did this turn into a personal assult on ME? Obviously you didnt read close enough on what I wrote. Look, I wrote when I was on paxil years ago that the drugs gave me a huge desire to drink. I thought I was an alcoholic. I couldnt stop! I tried everything to shake it. Then I stopped the paxil. Within two weeks I had NO desire to drink. My pastor regards me as being away from the heart of Christ and a sinner. And he said that once I was saved and now Im "fallen back" because of my arrest!
And as MUCH as someone WOULD believe that Im lying about getting dumped with booze YOUR WRONG!!!! I know it is hard to believe! I fully 100% understand that! I darn near crapped in my pants going in with that. But THAT was the TRUTH! I said something I should NOT have said to a woman that turned out wanted to do something sexual illegal to me, so the disgusting ***** **** went to punch me with the glass and while doing that the stuff IN the glass got on ME.
I understand folks reactions on here I guess. I also bet you ALL are very nice. I just had an idea of what I think the State SHOULD do and what they currently do and I wanted to get everyones reactions.
I firmly believe the States should have a license to all people to drink. Whether they say they are driving or NOT, they may only get ONE drink at a bar and/or a restaurant! Get the wreckless people BEFORE they get on the road!!!!!!!! And if they are convicted of a DUI then that drinking license is revoked and they CANT buy ANY alcohol. ANNNNNND if someone buys it for them its a felony!!!!!!
That to ME is FAR more effective than this current system that I feel is 100% BS.
(My avatar...... Hmmmm..... it me chewing dry pretzels??? lol )

I have read everything posted, and I have absolutely nothing to add.. Shallot your personal logic is funny to me, in a really sad way.
You asked for reactions, and you got them. They didn't agree with your opinion so now it's a personal attack... yeah ok.
Please, enjoy your one drink a day.. I'll continue not to drink and never fear having to defend a DUI.
Leaving this ridiculous thread as well.

So how much would one have to pay for this awesome alcohol license? One drink and your done for the night? Yeah, that would put every bar out of business. Haha...how about just calling a cab? Have you ever heard of the Bureau of ATF. I wonder what their take would be on such an idea? Something tells me they would suggest to not drinking and driving.
I don't drink and drive and never spend any time worrying about how unfair the penalties for breaking this law are. Just don't need to. As far as all cars having breathalyzes, why should I have to pay the extra added expense of such device if I don't drink? Naw, that just doesn't work for me.
Sounds like you want a cause and want to take action and change laws. Perhaps you fear another possible DUI in the future? By the way, the cost of a funeral service for a loved one is quite spendy too. No license for burial necessary at this time, but that may be an idea though. One per customer.
Yes, I'm being glib, but these types of threads never go over well. Drinking and driving is a serious crime. The fines of drinking and driving are not tantamount to the life of a loved one. Punitive damages are a part of the system. I see nothing wrong with that and would never agree that the punishments and fines are overly harsh.

OK, here goes..............
"...Someone is not going to be arrested for drinking and walking or drinking and riding a bicycle..."
You've heard from the folks regarding bicyclists, etc. getting DUI's, and a person walking......YUP....got one myself; they're called PI's; that's for Public Intoxication....
Now, about this license to drink deal.....? You heard what would happen to bars; they'd go out of business. .....and a personal limit on how much a person could buy.....? It's been done; they were called State Stores, and they were worthless......any other bulbs burning up there.....?

Umm...I know that in Florida bicycles have to abide by the same laws a drivers.
How do I know. Because I have been stopped and ticketed for riding the wrong way on a one way street on a bike before. I also have been stopped and ticketed for not stopping at a stop sign on a bike before. And I also was stopped and ticketed for riding on a sidewalk on a bike. All traffic tickets just like if I were driving a car. I dont know about goin to jail for riding a bike drunk. Because I dont drink. And like I said.Thats Florida. And too many cops with too much time on their hands just looking for any excuse to search me and mess with me. All of them were thrown out. I did have a warrant for my arrest for not responding to the one on the sidewalk. It was charged with failure to appear in court for the ticket. And yes I went to jail then. But the judge shook his head and said he couldnt believe they actually gave me a tickert for that. I guess thats what happens when you get on a first name basis with the police. And not in a good way.

Im sorry if Im crabby. IVe seen so many sides of this topic in my life (I have been in politics for quite a few years regarding my job.... ex-job) and it just doesnt make sense. So many more things can be done to save lives. Calling a cab? Well what happens after a few drinks someone feels like driving???
That doesnt work. I feel we need to regulate the amount someone can drink at bars, clubs and restaurants. And if a bar goes out of business??? GOOD! Drink at home! What if all the bars going out of business saves 10,000 lives a year??? Sounds damn good to me.

What difference does it make where they drink? They still can hop in a car a go barreling down the road. Regulating alcohol sales wont do anything except make illegal liquor houses rich.
You can buy anything you want in the street.
When I was a kid I use to get my butt whooped. With a belt a wooden spoon anything that made sure I got the point of what I did was wrong. And let me tell you. It hurt like hell. Especially that spoon. I thought about that dam spoon everytime I got froggy.
So to get a message across sometime there has to be reprecussions. Regulating anything isnt goin to do much when poeple can break the law. Like they are doing to begin with now. Whats the difference?

Hey TheShallot,
I personally have no problem with you posting this thread. I find it to be an interesting topic. I happen to completely disagree with you, but don't mind hearing your opinion. You did mention something that I will focus on. You said that people should be able to drive to work. It would be great if people could drive to work, but that would not work for an alcoholic. There are many alchoholics that drink first thing in the morning and drive to work. The reality of the situation is that we have laws and if you are caught breaking them, then there is a price to pay. I think all of those fines and consequences are a huge deterrent for people not to drink and drive.

Just a couple comments, regarding the bike and walking thing, (no lawyer here, but) I believe it's a state issue.
My DUI class in Texas said DWI it's defined as operating (and can be interpereted as having possession of) a motorized vehicle while intoxicated, so technically a lawmower, scooter, even a motorized wheelchair would qualify, he'd never heard of a bike, and didn't think it would stick in TX.
I have a good friend known for 15 years, got his 3rd DUI in Cali on his bicycle. (they call it a CUI, but since it was his 3rd, and he was in an accident they elevated it)
I guess out there they consider them a vehicle because they have to obey every other rule of the road, they have bike lanes, they have to stop at lights, they can't drive on the sidewalk, they are considered a vehicle.
Now if you were walking in Texas they could actually hit you with alot of things, including DWI, if certain situations existed. In texas, if you're walking to your car, with your keys in your hand, they can for sure. and my DWI class instructor said they do it all the time at bars, 7/11s places like that. They come through his class all the time. That's why the old pull over and go to sleep in the back with your keys doesn't work, you'll still get a DWI because you are in "control" of the vehicle. He said one girl was sitting on her parked pickups tailgate drinking vodka... sober people around, she had the keys, her car, she got a dwi.. I'm not bold enough to call this policy good or bad considering my personal history.
Alsothough I did hear a funny story from my DWI Class instructor of a passenger who was drunk and stearing for a sober guy eating a burrito or something.. cop stopped them, would have let them, go, and sure enough the passenger got the DWI because he opened his mouth and said he'd been steering. "Operating a motorized vehicle while under the influence."
stupid.
there is alot of talk about DWI's at legaladvice.com but I will warn you guys, many there think "they" are the victim. it's sad.

Shallot,
The point about this entire thread being out of bounds is completely valid. This is a recovery website. Its purpose is to help people get or stay sober, and help the loved ones of an addict/alkie deal with the addictions.
This thread does none of these things. I am sorry I participated in it.

I recently took a defensive driving class in TX to reduce the cost of my insurance premiums online. A very major segment was dedicated to drinking and driving. They presented some interesting facts. Among there are the probability of having a fatal accident with various BAC levels. Here are the numbers they presented.
Chances of a Fatal Collision
BAC Levels
.02 - .04 = 2 TIMES
.05 - .09 = 11 TIMES
.10 - .14 = 48 TIMES
OVER .15 = 380 TIMES
They also had a video of a young man who had drank at a weekend party, crossed the center line causing the instant death of one person and another person being burned alive but surviving with complete disfigurement. They interviewed the young man from prison. It left a very lasting impression on me and made me feel very grateful that I do not drink.
Knowing that every year thousands of people lose their lives needlessly from drinking and driving I suspect the laws will continually become tougher in the future. Many countries already have BAC limits of .05 and less.

After reading another example of ignorance in America, the below song came to mind; IMO, anyone who wants to question the legitimacy of fine structures in the American legal system might want to investigate how DUI/DWI is handled in other countries, we are the most lenient. Now, where is that thread on cheese and whine?
My bologna has a first name, it's O-S-C-A-R

Oh, I love to eat it everyday,
And if you ask me why I'll say. . .
'Cuz Oscar Mayer has a way. . .
With B-O-L-O-G-N-A.

I know you are upset & know exactly what you are talking about!
I am going through it all right now. And yes I lost my job as a result, and we are in dier financial trouble as a result. I dont even know if I can afford to get my license back next month because its because its nearly $1000!
I know I am having panic attacks as a result of the whole deal.

You may have not meant it this way, but just in case...try not to resent yourself...resent the past behavior. From all your posts i have read, it sounds like you are doing great so far. How is the relationship thing?

I'm going to tell you something I learned in my early recovery. You might not like hearing it like, I didn't like hearing it.
Did you or did you not knowingly, get behind the wheel of a car after drinking>
Last time I read up on it, they made a law against drinking and driving.
Anytime, we knowingly, drink and drive, we have no right to cry about the punishment that's imposed on us period.
I don't even know if, you're an alcoholic or, you just used bad judgment. Either way, if the punishment hurts bad enough for you, maybe, everyone that, wants to complain about breaking the law will not do it again
