NYS lifetime driving revocation imposed by DMV retroactively

Hi, I signed up for this site hoping to connect with others who were subjected to this. New York State Retroactively revoked driver licences for life after making a new rule in 2012.

I got a DUI, the second in 2009 did everything I was supposed to do and was issued a licence in the new state I moved to in 2011. Sober for 6 years and went to renew and was told NY is preventing me from getting a licence. I called a NY lawyer to find out what was going on. I got the news I that the day my licence expired on my 48th birthday in 2017 I was subjected from then on to lifetime driving revocation.

The lawyer said its impossible to fight it. I smashed the bathroom door off the hinges, busted holes in the walls with the lawyer still on the phone. I started a whole new life from that drinking hell that destroyed my 30s in 2010 and was back driving and functioning by late 2011. Did all the requirements.

In 2012 this happened

"Three or more convictions for drunk or drugged driving over the past 25-years, plus any other kind of serious offense such as involvement in a fatal crash, a criminal conviction for a driving offense, two or more convictions worth at least five license points, or accumulating 20 or more license points over the course of the past 25 years."

I had one impaired in the 1990s and 2 DUI 2003 and 2009. The points I got as a teenager when George bush senior was president. 25 year look back so they hold a man almost 50 years old accountable for speeding tickets as a teenager. Without those speeding tickets as a teen I would not be subjected to this.

I cant even share about this at AA because I am in a different state now and people argue with me "they cant do that" and "I got 6 duis and I got my licence back"

The worst is arguing with people at AA who tell me I have it wrong and say "they cant do that". I thought Googling it on the phone and showing them was the answer but I learned its best to not even mention it.

I think the terms of service here has rules against legal advice but even if not I don't want it. Spent weeks looking up all this stuff.

They say they make exceptions for "unusual, extenuating and compelling circumstances" but they never do. I have Type 1 diabetes now. I cant get to doctors regularly. Insulin is several hundred dollars a month. Can't get a good job no licence.

My mental health is deteriorating. I usually wake up and contemplate suicide cause every day is the same the struggle cant get around like everyone else. I souldent do it but a big cup of stong coffee and a few cigarettes makes that thinking go away.

I am done. Almost 50. Single cant never drive again. I plan to suicide after my step mom passes away, she is 81, I am going to commit suicide. I cant do it to her but after she goes I go too.

The social isolation. No woman is going to seriously date a guy that cant take care of himself or her cause he cant drive. No way am I getting old and dying alone going blind and amputations long term diabetes complications. I have a plan for a painless suicide.

I am so angry. I am sorry I had alcohol dependency and drove that way decades ago but this is so unfair retroactive revocation after I had a full recovery.

Thats it I am sorry this is too long. I came here to see if I could connect with any of the 1000s of other people they did this to in NY.

Going to AA and sharing about this is useless. Again they argue with me and I don't think outside observers can know what its like to wake up every day knowing your never going to get your life back. Never get to live like other people.

I don't want any legal advice or "I am sorry that happened to you" I want nothing else but to connect with some other people who have been subjected to this. cause they are the only ones that can get what its like.

That's all I want is to connect to others going through the same thing.

Dee74 09-02-2019 05:07 PM

I'm sorry you have to deal with this - I have no experience to share.

I know you don't want advice but I'd get another legal opinion. Doesn't seem right (as in legal) that there's no avenues to fight it.

Just to look at things from another angle tho - I don't drive, by choice. I've had relationships, I'm married now. I have a great social life. I get lifts, I catch cabs and other public transport.

A mate of mine bicycles everywhere. Also by choice.

If you're feeling really low about this please look at getting some help.
I'm sure this is traumatic and I'm not downplaying your pain at all - but it's not worth losing your life over.

I've never had this happen to me so can't speak from experience, but I agree with Dee. Get another opinion from a trusted lawyer. If there are ways around it, get a lawyer who will do that for you. Please don't give up hope.

"I don't drive, by choice. I've had relationships, I'm married now. I have a great social life. I get lifts, I catch cabs and other public transport."

That's Australia. I am in the US. I don't like the city. I am also guessing you are female and its socially acceptable for women not to drive as its a mans job.

Even on that dating website plenty of fish it has a checkbox "do you have a car" so women can weed out loosers.

Taking an american guys car is like cutting your ****s off.

I would just drive anyway but as an insulin dependent diabetic going to jail would be a nightmare for me. Other people its just a time out. They would probably force me to use the cheap insulin that peaks hard two hours after you take it instead of lantus. I Googled diabetes in jail and they kill us all the time with substandard care. You cant have your blood sugar meter. My sugar is low, I feel it, help me... They will just let you die an awful death, seizures, coma they do it all the time to us. Or worse you come out with brain damage they do not care.

This started in 2012 them doing this to people. I want to find the others and see how people are doing. My guess is our suicide and overdose rate is higher then any other demographic in the United States. Can't get to meetings, cant get to doctors or outpatient... knowing you will never have a normal life again.

I am an AA, I know what the 'f its' are. Its almost like NYS designed this drive us to suicide and overdose. Social isolation and hopelessness about the future financial problems...

I have changed. Never been so full of hate. Didn't know what hate really was till they did this to me after almost 6 years of soberly and doing the right thing.

Cant prove it but I drank hard after the news and I think that caused the diabetes. After I got that news out of no where never saw it coming it was like I never quit drinking I just wanted to drink.

Thats the real killer now. Diabetes and drinking is an awful experience. You can do it but it screws your sugars all up and ruins it. I drank to forget and feel good not stab holes in my finger every hour to make sure the alcohol is not giving my a hypo.

They don't even care I cant drink anymore anyway they want to handicap the rest of my life, no driving, all i can feel today is hate.

Every few weeks this happens I cant push it out of my mind and dwell on it. Usually after it rains and I am stuck at home alone for days.

If anyone one else living NYS nightmare this finds this post sign up for this website and talk to me. I want to start a support group for us someplace online.

5 year revocation, I could handle it. 10 years is a long time but light at the end of tunnel. Lifetime means till the day I die. Punish me for tickets as teenager till the day I die.

I will be 60 years old people will ask why dont you drive. Well 40+ years ago I got speeding tickets when Goerge bush senoir was president and have too many points.

I was abused in boarding school and learned to drink to cope at 13 and became alcoholic. Where was the state to protect me then ? My sister was sick and my parents thought she was going to die so the sent me to boarding school I guess so spare me of something but all male boarding school 1980s playground for pedophiles. thats what that hellhole was. My sister was alright . At 13 I had thnat drink and I felt like I finally knew how to act. drank whedn ever I could after that.

Overcame it all now they destroy me. All I can do is feel hate.

You know what I would like, help finding the other people they did this retroactive lifetime driving revocation too. Legal researchers might be able to do that with public records.

I am convinced our suicide and overdose rate must be higher then any other demographic. If I can prove that I can fight back at them. Search each name followed by the word obituary.

Dee74 09-02-2019 06:42 PM

yes, I'm am Australian but no, I'm not female :)

Full disclosure: I am disabled - but I could drive if I liked.

Just never liked driving.
Don't feel less of man for not doing it either.

Sorry my experience is not much help to you man - best wishes in getting it sorted out tho.

ktaylor 09-02-2019 07:38 PM

Thank you.

I don't mean to be dismissive. It different choosing not to drive and some nameless faceless government agency imposing it on you never even meeting you. Never looking you in the eye just a cold unsigned letter in the mail.

Got myself good and worked up today. What I do when I get depressed is start drinking cups of coffee one after the next the same way I did with beer. Its the same behavior different substance.

Maybe this will work. I will find other people subjected to this. I saw when I was signing up don't use your full name posts may show up on search results. I want that to happen.

I can find other recovering alcoholics pretty easy. There are dozens of online support sites like this one but for diabetes.

I am all alone dealing with the reality lifetime revocation and the retroactive nature. I did my jail time with the promise in the plea bargain one year revocation. My brother had aneurysm and died wile I was in there. I went to his funeral with the sheriffs department for a 10 minute good buy.

I could have took probation but the deal was one year revocation plus jail. But they just changed the rules after that in 2012 and gave me lifetime revocation. They don't honor their deal cause those cold soleless automated "just doing my job" people in NY have no honor.

You don't give someone a $50 ticket for jaywalking then tell them 6 years later the fine is now $100,000.

2009 one 24 oz can of beer. 8.1 % steel reserve. Got me right when it peaked I was over the limit .

Ok thanks everyone for replying. I am coming out of the rage episode. Went for a walk after the last post when I was deep in it. I hate them so much.

Maybe this will work. I found comments on lawyer websites that come up people searching this 2012 DMV retroactive revocation thing.

I keep repeating myself I just want to talk to people going through the same thing.

First they tell me no driving for l,ife. Then I get sick sick yourself with insulin welcom to type one diabetes.

I hate NYS . Kill my life.

ktaylor 09-02-2019 08:45 PM

I will keep checking back to see if anyone else subjected to the retroactive DMV thing posts something even if it takes a very long time., I got a 'lifetime'

It can't be just me that feels like this. Has this anger. I want to know how others are doing. How you cope with it.

Thanks Dee And Least for replying to me.

Dee74 09-02-2019 09:43 PM

You'll likely get more replies as time goes on ktaylor :)

i live in a large metropolitan city and MANY people, men and women, choose to not have a car. it's no longer a status symbol or a sign of manhood.

curious if this happened two years ago in 2017, what is causing such an angry flare up about it in 2019??

I don't like the city. Never been a city person and never will be. I would never be happy living in a large city. If you want to travel you can rent a car. I can't

I have diabetes and have to find my way to try and get fresh food eat healthy, get to doctors, pay 100s a month for insulin...

Every day of my life I resent seeing other people who got 3 4 and 5 DUI got sober and can drive but ME cause I once lived in NY have different rules even outside that state.

IN 2017 my out of state licence expired and they refused to renew because NY put me on the nationwide list RETROACTIVELY after this was all behind me and I started a new healthy life. Living a normal life using a car for half a decade after getting sober, starting a new successful life and they take it all away from me.

Angry "flare up" in 2019 cause this effects me every day of my life I wake up to something so unfair and have to struggle . I NEVER HURT ANYONE. They hurt me EVERY DAY.

2019 2029 or even 2039 if I live that long I will hate the state of NY as much as I do today.

I will never accept this. It is retroactive. EX POST FACTO LAW. I never would have even went out that day if the law at that time was lifetime revocation.

ktaylor 09-06-2019 07:27 PM

Angry "flare up." Like something is wrong with me as opposed to what they did to me.

I don't think I am going to reply anymore unless I get lucky and people subjected to the retroactive ex post facto thing from NY, same as me, find this thread in a search and sign up and post, or are here already and find it.

ktaylor 09-06-2019 08:14 PM

Maybe I over reacted but hemmeroids "flare up"

I got 2 DUIs , plus speeding tickets decades ago and lifetime driving revocation cause I had the misfortion of living in the most vile state on the planet.

I know people in AA that got 6 and 7 and get their lives back.

I don't think I should reply anymore. Been though it already people telling me my feelings toward this injustice are invalid., and my reaction. I don't want to get booted from this website and lose my chance of contacting others subjected to this draconian treatment.

I learned other things along the way too. Got a regular meeting but NEVER go to an AA speaker meeting.

More often then not "what it was like what happened and what it is like now" Includes what happened is more DUIs then I ever got and what it is like now is they leave after the meeting and get into their car and drive home to their normal life.

Me NYS wants dead.

SoberCAH 09-11-2019 12:04 PM

Thanks for sharing all of this misery.

I wish that I could help you.

Is there any way you can move to another state?

They're certainly not all the same.

Keep us posted.

Callas 09-11-2019 01:25 PM

I get that you are angry. I would say first explore all legal options and find lawyers specialising in this sort of thing. Only give up when all avenues have been tried.

KyleT 11-05-2019 05:04 PM

Left my laptop out on my table lost all my saved passwords but I am back and memorized my login this time.

Today I finally made an effort to track down some other people subjected to this. The very first name I searched and the man is dead.

Some people filed court cases. Try and contact them.

Thomas GAEBEL, Petitioner, For a Judgment Under Article 78 of the CPLR v. NEW YORK STATE DEPARTMENT OF MOTOR VEHICLES, Respondent.

No. 1333–2013.
Decided: November 27, 2013

So the first thing I did was search his name.

The result:

findagrave. com/memorial/178567527/thomas-m_-gaebel

Died on Sunday, April 16, 2017 at his home.

FRom his court case:

Arguments

The Petitioner asserts that the revocation of his license creates a hardship, because his back injury requires him to attend doctors' appointments and there is no public transportation to permit him to get to these appointments on his own. At present, the Petitioner indicates that he is not even eligible to get a conditional license, which would permit him to drive to his medical appointments.

The Petitioner also argues that the application of the Part 136 which was amended after he pled guilty to DWI results in an impermissible, unconstitutional, ex post facto penalty. It is argued that the Petitioner had notice of the revocation period he was facing at the time he pled guilty to an alcohol related driving offense, but was instead subjected to additional penalties which were not in existence at the time of his plea...

---------

He lost the case.

IMO they NYS killed him. Couldent get to doctors , AA meetings or live his life. Trapped at home like house arrest.

Spent enough time in treatment and around AA to know you take all hope away from someone what happens. It can't be just me that contiplates suicide. Every morning I get up with no plan cause its same thing every day the whole world is a prison cause I cant get around. Never getting better.

I think it was a sign from God to keep looking for the other people subjected to this and see how many others are dead. Forward my results to the centers for disease control that track death by demographics.

Life expectancy in the US is going down they call it "death by despair" and again as person who spent along time around recovery and subjected to this retroactive revocation myself I honestly could not think of something more evil then taking away all hope from someone with addiction or alcoholism and expect any other result then there death in a few years. I thinkl it was a sign that the first name I searched is dead. Sign that I should keep searching.

The National Driver Register (NDR) is a computerized database of information about drivers who have had their licenses revoked or suspended they all look at it and deny you.

I am done

I hate them. hope they go to hell.

KyleT 11-05-2019 05:53 PM

How do I find the other people they did this to? I have no one to talk to that gets this.

KyleT 11-22-2019 05:35 PM

No new posts and no messages. I check at least once a week.

This comes up on searches. If you found it and have the same thing sign up and contact me.

Stay strong they hope we drink use and commit suicide. Dont give it to them.
