Minimizing cusody issues My AW is in a slowed, almost controlled relapse. Over the counter meds that cause drowsiness seem to stay within constant reach, but the controlled Rx's have slowed down. They only get filled within the time frame that the insurance allows, wheres before they were being refilled off of our insurance and simply paid as cash. All that being said, the OTC meds and the prescribed Rx's are still being aggressively taken. How would one prepare the best way for custody fight so as to minimize the time this DA has with a child? Sure a lawyer could answer that best, but any insight from anyone who's lived it would be welcomed. Thanks |
Hate to say this, but I know sometimes it is necessary to assist in protecting the child(ren). Start a journal. Note dates and times that you observe her taking this medi- cations, both Rx and OTC. Note date and time of behavior incidents (ie sleep- ing since _______, faling and stumbling since _______etc) and the times will be very near when the last pills were taken. Talk to an attorney he may suggest snapping pics with your cell phone, IDK. It is called CYA (Cover Your Azz). An 'ongoing' log of the above, by date and then time can only help to show that "Supervised Visitation" for the protection of the children is the only way to go. Every state is different and every Family Court Judge is different. An attorney who specializes in divorces and family law should not only be able to tell you what types of 'proof' you will need, but also which 'Judge' will be best to take this type of petition and/or legal separation or divorce before in the hopes of getting a positive outcome for you and your child(ren). Thanks for the reply to my post. It is helpful advice and something I've been doing for awhile now. We have floated through the child welfare program once as they heard of her issue and were told I was doing nothing to stop it. I want her to be involved throughout this child's life and to be a parent, but I won't accept him being in a negative and potentially dangerous environment. |

That report can be an 'asset' to your petition to the Court, as you can show that you are attempting to do something to 'stop' the child from being in the 'toxic' environment. CPS can be an 'asset' for you in this. It might not hurt to talk to the Social Worker that wrote the report, and tell him/her that you are taking their report 'Very Seriously' and do they have any suggestions to help you get this 'Supervised Visitation' approved by Family Court (they have TONS of experience with Family Court, lol). Better to have them as a 'friend' rather than as an 'enemy'. I applaud you for looking out for your child!!!! They are like little sponges and absorb so much information, and living in 'toxicity' as a child can affect them into adulthood (just go read some posts over in the Adult Children of Addicts/ Alcoholics forum). You have to have proof. Document everything. Contact a lawyer. Do you have drug dealers names? Any witnessses? I think addicts only deserve supervised visits. |
