Another way to tell if he's high besides physical signs: he acts like he's in a good mood, but in a weird, detached manner. Like he's not completely "there".
When he's not high (besides what has already been said): preoccupied, restless.

No matter what drug(s) he is on, he is an addict, there is no future with a person who is in the throws of active addiction. He has made it clear, he will continue to use, and is not seeking recovery.
Days turn into weeks, weeks into months and months into years, and if nothing changes, nothing changes.
You have a daughter, she must be your first responsibility, period, end of conversation. No young child deserves to be exposed to an addict or their behavior, and you are the one who must draw the line to protect her.
