Talking Motel 6 & Job Seeking

Teehee- I decided that my ex-employer could wait until Monday to get the laptop back. Of course I informed them first and they were fine with it (they're withholding my checks until I drop it off anyhow so they don't care). I'm hunkered down now in Motel 6 with the cat and am using this entire weekend to avidly search for jobs on my local jobsite and monster.com. I've already applied for at least 15 jobs and there are a lot of very promising things out there for which I qualify. Leave it to me to not waste any time! Once I get obsessive about something, I cannot be stopped!

All is going very well considering my circumstances. I am looking forward to this new place, new job, new life . I do not miss AH and maybe this was HP's way of distracting my mind away from all that. I don't think I'd be one to sit around and pine over it, BUUUTTT-- at least I have MY immediate needs that are taking up all my thoughts and energy. That's not a bad thing.

Ok- I did the math on this "final" commission check that my employer says he owes me and it is about $1100 short according to MY computations. I will kindly ask to be shown HOW in the world he came up with that number tomorrow. If the company cannot justify it, I will NOT lay down like a dog and let them jip me out of what I'm owed. I will not only be searching for jobs today, but I'll also be checking into GA state labor laws to see what if any case I have if they do not comply. The problem is $$ for an attorney tho and my company knows it which is probably why they have the gall to do this in the first place.

I'm off to go buy a nice suit for interviews now. Since all my nice clothes are buried in storage, my mother pointed out to me on the phone that this is a perfect time to shop . I hope all is well with everyone and keep on keepin' on.

You won't need an attorney, you go to The Department Of Labor for the State of Georgia, if the company only does business in Georgia, or to the Federal Department Of Labor if they do business in other states as well, and you FILE A FORMAL GRIEVANCE COMPLAINT.

I had to do that against a company I worked for and not only did they end up getting heavy fines from the State and Federal Governments, I ended up with a really nice 'settlement check' order by the Federal Mediator.

This is what we pay taxes for, if they have violated a State and/or Federal law, you file a formal grievance with the correct governing authority and they do it all!!

Motel 6 & Job Seeking??? Kind made me wonder 'exactly' what you were referring to there Mega LOL!!

Sounds like you are handling things very well. Glad to hear it. Isn't the peace and quiet refreshing, to say the least? Enjoy!

Regarding your final commission check. Do they take taxes out? If so, and it is a relatively large sum, the $1,100 difference 'could' be attributed to that. With higher earnings, the higher the tax amount they take out. They don't give any consideration to it being a lump sum one time only thing. Figure out what you think you earned, then look up what the tax liability would be for federal, state, city (if applicable). That just might be the difference.

Keep us posted on the job search, oh and, don't settle for less that what you deserve!

laurie, How long ago did this happen?? I am really really pesimistic about our Government in the last few years.

Won't some attorney's take cases that they feel are a sure thing, do it on win or you don't pay??

mega, I think you will be OK no matter what. You will check everything.

Clancy, mine was quite a bit ago, however, the neighbor across the street just got a settlement check.

He worked here locally, but the "Home Office" of the company is in California, and they too were pulling "crap" and getting away with it, until he filed his grievance.

He did this in October of last year and the finialization was May 23rd and he received the check June 9th. The government gave the company 3 weeks to comply and the check had to be a Cashier's Check. He then had to take it to the Federal Building here, so they could make a copy (well several copies) of it for his file, then he was free to do whatever with the money.

So, yes when it comes to Labor Departments of State and Federal, they do seem to work for us poor peons, lol.

Thanks so much for the advice everyone. I will file a complaint with the Dept. of Labor if that it what I must do. ICU- you bring up a good point. Yes, taxes are withheld from my commission checks. I just need to see the actual check and then go over how the total was figured with the payroll manager to make sure I'm not being shorted a penny. If they are short (which I'm pretty sure they are regardless of the tax liability), they will need to justify why they are short. There is a couple of scenarios I've thought of which would be reasonable and I would accept those. I just want to make sure that they are not trying to shaft me any more than they already have!

They are a VERY frugal company and will pay as little as they possibly can to anyone if they think they can get away with it. One thing I'm concerned about from the legal aspect is that we have absolutely no agreement in writing as to the amount of my commission. The company is a very small family run business and therefore, our agreement was verbal that I would get 20% of profits. So far on every other check the numbers add up so I never brought up getting the figure in writing (my bad right?). I wonder if the previous checks could stand as "proof" somehow.

Absolutely Mega, the other checks are PROOF that although verbal there was an agreement in place.

Now, stop fretting about it. You know what you can do if this last check isn't correct,..........so why not enjoy your free time a bit......pretty soon you'll be in that new place and able to decorate any way you want, and with job hunting you will be one Busy Bee.

Be good to yourself, why not go get a banana split or a hot fudge sundae tonight for a treat? lol

Good idea Judy, I've heard some good things about craigslist.com.

Thanks for the link Judy. I've never heard of it so I'm off to do that as soon as I'm done here. I appreciate it.

Banana split?? LOL- Oh Laurie, I must have gained about 10 pounds within the last couple of months. It's like it really crept up on me slowly. My AH and I were eating out (mostly fast food) all the time ever since all this divorce stuff started. It's like cooking and all other domesticity flew out the window! Anyhow- I could really tell I gained weight recently b/c of the way my clothes fit and when I got to the motel, I did the whole look at myself naked in the mirror thing (I know-- too much info right? LOL). OMG--- I'm soooo out of shape. Anyhow- I went shopping for all healthy stuff (I've got this mini-fridge and mic in the room) and have been very disciplined with my eating since yesterday. Two whole days right??? LOL-- gotta start somewhere.

I'm not fretting too much about all this really. Everything will get done and I will survive and come out of all this all the better. I cannot wait to get moved and settled. It will be wonderful when life sort of resembles "normal" for me again. The world is my oyster baby!!! I had a little mini-vacation scheduled for the weekend of 7-21. It's my goal to NOT have that interrupted b/c of this setback. I've been soooo looking forward to it and need it very badly.
