Visitation of the kids?

I'm in the beginning stages of separation, it has only been a month. We are in the process of having Soberlink set up and until it is, he has supervised daytime visits with a no driving restriction. (Un)fortunately, I have 5 police reports from the last 5 years, three of which report elevated blood alcohol levels that back up our request for these restrictions. Once the Soberlink device is activated, he will be allowed unsupervised visits, with overnights every other weekend. He will also be allowed to drive with them. The proposed testing schedule is for him to test before pickup and before drop off for his week day visits and a 9 am 3 pm and 9 pm testing schedule for his weekends. A missed test will be considered a positive test and visit will be cancelled or the kids will be picked up immediately. My attorney is leaving it open ended as far as duration of testing. He is currently attending meetings and appears sober and, based on past history, I expect him to remain sober for the next 9-12. months. I'm still glad to have the assurance of the monitoring.

If no hiccups arise today, as of tomorrow I will have the following sobriety monitoring schedule in place for my AH, who has alternate weeks of custody of our 3 children: he uses Soberlink 3 times/day (morning, mid-day, before bed) and transmits the results to me; a missed or failed test means I pick up the girls and we go back to mediation or court to renegotiate. The testing period is every other week, while he has custody, for the next 120 days (4 months).

That's something I'd bring up to your lawyer.
Not sure about the state you live in but here where I live, a DUI conviction will prevent him from driving for at least 90 days or more for the first offense longer if it's a repeated offense it will be longer.

I echo the words of many here, get a lawyer and show your concern to the court IMMEDIATELY. You have every right to be concerned for you kids, and if I were you would not allow him to see them unsupervised. That way you can show the court that this is what you have been doing for x reasons, and it has been working and they will likely continue it. This has been my experience, having an xAH and almost identical situation.
