I have always struggled with the covenant of marriage also.
I believe now that in cases like yours (and my 2d marriage) that the marriage has all ready been dissolved by the other partner. They are no longer living in the sanctity of marriage and so have left it, therefore it isn't the divorce, per se, that ends it, it is acknowledging the truth and reality of the broken marriage.
That 2d divorce I had to remember the verse that teaches if an unbeliever wishes to leave, let them go.

Thank you everyone for your support. There has been a little delay ~ my father passed away very suddenly this morning. I need to take care of this first, then I will deal with my husband.

Oh! and the other thing is my husband has really stepped up and is behaving like a kind and loving person... leapt out of bed when we got the phone call this morning to rush to the hospital... genuine hugs, tears and compassionate comments... stayed all day with the family...
