Yes that’s the point I’m at right now with the ex. She’s hiding from being served and I’ve hit the financial wall on tracking her down. Funny how some things never change.
In Alanon we learn to give it up to our higher power, so I guess I need to let this go for now also. Everything else has seemed to fall into place so far to move forward in my life, I guess I need to see where this goes now that I did the footwork on it.
Pushing issues in life never really worked in the past and suppose they won’t work now.
So I’m at a new point, she on the other hand is at the same place. Her words to me in talking about herself were “ I’m not in my right mind”. I guess that says it all

No Mr C it's not a stalemate, that is what "publication" is for.......whether its for divorce or recovering on a debt, ie foreclosure.
Once the notice has been published for four weeks, your attorney can go ahead with any and all court proceedings. He presents to the court the efforts made to serve her, and the publication dates and proof thereof, and on goes the dissolution of your marriage.
She is playing the game, and you don't have to dance to her tune.

My AH (who, by the way filed initially for the divorce) has been MIA and missed two court appearances. The next one I get what I asked for. And the divorce will go through, too. Talk to your attorney - you can proceed with or without her. You did your best.

I agree this is not stalemate at all...
This is just her making it easier for you to get a divorce, after you publish it and wait the 4 weeks it will be granted to you just the way you wrote it up... and she will have no say in the matter.

As far as the attorney is concerned she tells me I must file with the court 1st to be able to go into publication.
Another $400 to file this then prove I can not serve her. Then the judge may not grant this. Then publish it, which in the end the whole thing will run about $1000. But only if I’m granted it.
This I can not afford at this time.

Ah the old legal battle of attrition, he who runs out of legal fees first... I was afraid that was your point. Sorry man, it will just take some more time but it will get resolved. Doesn't really stop you from living your life ya know. Keep up the good work Mr. C!!!

Okay, I'm not sure of CA's policy on serving folks - but if it's just proof of delivery such as a certified letter, you could try finding a box from a store, putting the papers in there and ship it. Make it look like it was shipped from the store. Clean tape lines etc. Print an online label from a service like FedEx and require her to sign for it. Since she'd be on the look out for a letter, she would most likely just sign for it.
Just not sure if that's legal in your state, so you'd need to check on that.

Mr C, This is just a suggestion. Ask to meet with her, tell her you want to talk, make it sound good! Then have anyone walk up to her ask her if Mrs c is her name, when she says yes have them hand her the papers. I can help you with the notary part my best friend & sister are notarys.
