Need a bit of help from anyone who has gone through this

It's about probate and how do I go about reporting fraud

Basically people have been stealing off my dead relative while I was tending to Mrs SW but there's no way I'm letting anyone steal off the dead especially someone I gave a **** about

Sorry I don't know who else to ask for help in this

SW, you will need to talk to a lawyer about this, a lawyer who deals with probate issues. I'm really sorry you have to deal with this. My experience when dealing with my Dad's finances after his death was that everything was frozen until probate was finished. But, I don't know what the laws might be in the UK.

Hi Soberwolf,

You could seek a caveat which is a order from the high court freezing the assets, pending a court case, to look into the matter.In addition, if fraud was committed you could report this to the police to investigate as fraud is a criminal matter as opposed to civil.Moreover, you should find out whom is the executor of the will and then look at the will document itself to see how the assets have been distributed.Good luck with this and you sober journey.

Not giving legal advice - more of a general guidelines type course of action.

If it's stealing as in the criminal offence of theft (or 'appropriation' if the person is already in possession of something and starts using it as their own), then you should immediately report it to the police as you would in any other case.
If the will hasn't been enforced or opened/declared yet, then the new ownership relations aren't in effect and no transfer of ownership (as far as the items/assets listed in the will) has taken place. Items/assets outside a person's written will are usually inherited 'naturally', which means following certain rules for who inherits what when (which comes down to somehow splitting the value of items/assets between rightful inheritors).

Another matter, of course, would be to prove something has actually been taken, so the quicker you notify the police (if you have suspicion that it's a criminal offence) and contact a lawyer who specialises in inheritance law, the better your chances of putting an end to what sounds like general looting of the assets that belonged to a person you cared about.

I don't know about any of this stuff I hate money I just don't want them getting away with this and it's disgusting what thier trying to get away with I don't want no money at all I just don't want them robbing a dead relative which is exactly they just did bare shady stuff on top I'm not even saying it's making me feel sick

I have no experience to share but I agree with the others here who've said if it's a legal issue...find a lawyer - most suburbs have a community legal service, I think?

If it's a criminal issue, call the police.

Hi Soberwolf, i'm sorry to read this. The only thing I know is that it is illegal to remove money from the account of a dead person unless it's a joint account. It might be an idea to contact your local Citizens Advice Bureau, they might not be able to help you directly but could at least point you in the right direction.

Btw you are right, it is a horrible thing to have found out.

From the sound of it you don’t have an adult protective services agency but if you do that might be another tool in the toolbox. I am sorry for you and glad you are sober and able to address it.

Thanks but this has now been let go by me I have lost every member of my family over this except my youngest neice but by default I lose her to which isn't fine but my ex family haven't visited once since mil died, we have been doing it alone looking after Mrs sw brother and father that's it that's family, not exactly blood but they would never do what my immediate blood relatives done Inc my father; but he's sozzled 24/7 and not sure how much of the man I once knew a long time ago is even there anymore.

All I ask kindly is if the SR mods can remove this thread as in deletion I know it's not protocol but this is something I never never want to be reminded of again I'm going to be ok went on a walk with glen yesterday were both knackered
