Question Ex's and credit card debt

After 14 months my divorce was final in Oct.
unknown to me at that time, there was a credit card with my name on it. Originally , I apparently got the card when we first got married. At that time, I must have added her name to the account as well. I didn't find out when I called the credit card company if she had a card with her name or was using a card with my name on it.
Today, in my mailbox I get a bill addressed to my old residence in my mail box for 2300.00 hundred. After calling the credit card company, I found out two weeks and one week before the divorce, she swiped the card and got the cash out.
If, she's not willing to pay this, can I take her to small claims etc. ?
Earlier, small claims took me to court for a hospital bill she never finished paying and I had to pay 3300.00 on that since it was on my insurance from work.

Sigh, when does it ever stop????

What does your divorce order/property settlement agreement say about debts?

We were just separated. She did sign and agree to assuming debts she occurred same as I did. It does appear she had made a payment on the bill in November .
I can pay the bill if, I'm forced to pay it.

If you are forced to pay it, you can probably turn around and sue her in small claims court. You'll need to be able to prove she made the purchases.

The cash was withdrawn from an ATM machine.
What I would to know from the bank what time the cash was withdrawn .
If, the cash was withdrawn while I was at work I hope, that would be in my favor.

Have you asked her about it? As in, "Hey, I noticed you made a withdrawal on that card. We should clear that up, but for right now the card is still in my name. What arrangements can we make for you to pay it?"

It was really your responsibility to take care of closing the card or removing her as an authorized user. If you are the primary account holder, you should do that immediately, if you haven't already done so. And change your PIN.

How you would make out in court if you had to sue her, I have no idea. Depends on what you can prove, unless she admits it.

I cancelled the card. I didn't even recall us having it.
She was pretty deceptive about letting me get the bills and opening them.
One time, I got the mail before she did, walked in the house opening a credit card bill with my name on it and she snatched it from my hand.

I believe cameras take pics of all persons making a transaction.

Those cameras don't keep the images for very long, though. At least they didn't used to. We had a few cases we investigated where we were too late to pull anything useful off of them.

In the UK, doing anything through the small claims court means diddly poo... I hope it's different where you are... good luck though
