Hello,
My son is in the county prison. He has some money on his books and is being sued by a credit card company that he owes money too. Does anyone know if they can take his money from his books in the county prison or state prison. He's headed there sometime in the future. Thanks anyone who might know.

Um, I really don't know, but I cannot imagine it would do them much good to do that, would it? I mean, isn't there some kinda limit to how much money they can have on the books at a time? And it's probably pretty low, right? So I would doubt they would waste their time with that, but it's just my guess...

Hmmm. I know there;s no debtors prison, so how are they going to sue him? By books do you mean money in an account at the jail?
Credit cards can freeze any bank account you have.
They do have a statute of limitations too, depending on the state, so I'd find out about that too.

I wouldn't think so. When my son was in jail, he usually had money on his books - $20-25 at a time. He also had more than one creditor after him. I never thought about it at the time, but I would guess the jail account is an internal system ... not something that would be shared with the credit reporting agencies. JMO

My son spent 6 months in the county jail in Pa.
He owed banks and creditors too. They can't/won't take the pittance that is his canteen money. It's a small amount and they don't have the time/man power to garnish is every week. They'll wait until he's released or press charges against him for payment when he's released.
You've come to a great place here and I hope you continue to come back.
Also, get into a recovery group/program for codependency, for yourself.
Believe it or not it's an underlying problem with people who love an addict.

Highly unlikely so I say no. The prison admin is not about to wrangle with a CC company. Not their job. And the CC company quacks alot. No judge would order a prisoner's account be garnished. It would take a court order to do so.
My friend just recently got out of prison. One of her creditors had my cell phone number as a contact (we used to be roommates). When they called me, I told her "she's in prison....I suggest you get hold of her when she gets out" and never heard from them again.
As far as fines or medical costs in jail/prison, they WILL take that out of the money on the books, because most fines are considered under the dept. of corrections.
