I just want you safe and warm in a healthy environment. However, I think your landlord needs to take some responsibility. At the very least, she should pay for a hotel for you to stay in since your apartment is filled with sewage, and you need some time to find a good place. Sounds to me like the whole building is a health hazard.

Telling you that you're evicted and have a very few days during a holiday week is at the very best, rude and in my opinion possibly illegal. You didn't cause the problem so it's not like a "Cease or Quit" situation. She owes you the return of your security deposit, as far as I know.

I'm so happy to know you're holding on to your serenity and embracing your recovery. Please do let your home group be of service to you. Accept all the help you're offered!

before anything gets TOO... dramatic.

I take my blessings where I fnd 'em!

Lenina-
The sewage in the bathtub was
three days of last week.
She got it roto rootered
about .. three days ago.
But ... I'm still taking showers
at another location
because one of the people upstairs
has HEP-C.
I'm sorry but there's not enough bleach on teh market
to make that tub clean for me ever again.
The pipes next door are still broken
but like I say the guy doesn't live there.


Wicked -
I *have* conidered the tv station...
but she's quite careful not to write anything
even receipts.

BUT-
I *do* have her on one point -
she said in her text that I owe her for December AND January
to be paid at once
and then she quoted me a rent that's 75$ higher per month
than I've paid.

Now, I DO have that in writing.

Anyway -
I think more than anything
I needed to come here
and get out of my own head for a while.

When you're up to your eyeballs in crap
it's harder than one might think
to focus on it being warm,
ya know?

In SF this would never in a million years fly because tenants rights are so important. I think generally the tenant has more rights than the landlord although certainly certain states give more favor than others. Here are some links to the state law. I probably wouldn't go anywhere if I were you come Jan 1 because it doesn't even seem like your landlord gave you legal notice. You might want to go down to your city hall and talk to the people there about it too. Good luck!!


so pretty sure text-message legally does not count as "notice":
70-24-108. What constitutes notice.

landlord's obligations to maintain premises including water and heat:
70-24-303. Landlord to maintain premises -- agreement that tenant perform duties -- limitation of landlord's liability for failure of smoke detector or carbon monoxide detector.

failure of landlord to maintain premises-tenant remedies:
70-24-406. Failure of landlord to maintain premises -- tenant's remedies.
70-24-408. Purposeful or negligent failure to provide essential services -- tenant's remedies.

70-24-411. Unlawful ouster, exclusion, or diminution of service -- tenant's remedies.
70-24-411. Unlawful ouster, exclusion, or diminution of service -- tenant's remedies. If a landlord unlawfully removes or excludes the tenant from the premises or purposefully diminishes services to the tenant by interrupting or causing the interruption of heat, running water, hot water, electricity, gas, or other essential services, the tenant may recover possession or terminate the rental agreement and, in either case, recover an amount not more than 3 months' periodic rent or treble damages, whichever is greater. If the rental agreement is terminated, the landlord shall return all security recoverable pursuant to chapter 25 of this title and all prepaid rent.
70-24-431. Retaliatory conduct by landlord prohibited.

when I show it to the lawyer -
he can read it while looking at your avatar.

That was the only way it'd print - to do the whole page.
