Need advice
 
Hi everyone,

Haven't been on here in a while. Things were going so well but now I need some advice. My AH was arrested for his second DUI. Just wondering if you all have any experiences with this as far as what I can expect. I know in the past it was probation, community service, classes etc. but with the second one I don't know. Should we expect jail time? If you could tell me your experiences if you have any it would really help. Need to know how to prepare myself if that is possible.

I don't have any experience with this, luckily. I hope whatever does happen will be enough to keep your husband from driving drunk again..

You need legal advice ...not all areas are the same.
Call the lawyer that he had with his other DUI.
That way you will have the correct information.

You can also go to your state website for the penalties, the laws differ from state to state. I know in my state it is very strict. Good luck.

My brother served 9 months but that was after his third DUI here in Colorado.

No two states are the same, but I have 2 dwi's. I had to serve a chunk of time, but it was broken up between trials and all that lawyer nonsense. In NM:
It's:
- 9 months jail or time served
- a 2 yr. suspension of license or an interlock
- some fines and probation

I'm currently on interlock and probation. I guess all together I did about 45 days.

As others have said, depends on state. It also could depend on time between the convictions, 5 years is far different in the court's eyes than 5 months...
