Agree with everyone else. I don’t know where you live, but my state requires evidence of substance abuse in order to have that be the basis of a custody determination. Inpatient rehab is absolutely considered hard evidence of drinking. You don’t have to see him do the drinking. Sometimes when rehab is in the past, it is hard to show a current problem. But you should absolutely strike while the iron is hot. I consulted with a custody attorney who was pretty straight with me about when I did or did not have a shot at full custody, so maybe there are facts I don’t know that make it particularly hard for you. But at the very least seek a consult with someone else for a gut check. I did better than she thought I was going to when I requested a change- sometimes practitioners can be jaded and overly cautious.
