That would be exactly my take on it. He agrees to something, then changes his mind? Tough noogies. Judges HATE this kind of crap. He has no logical reason--this is what we would call a "whimsical change of mind." It's not as if there were some intervening Act of God, that unexpectedly revealed something he never would have had reason to contemplate.
