Should i try to get social security disability again?
 

I have had major depression, generalized anxtiety, and addiction problems since i was 10yrs old. I have a psychologist and psychiatrist and i have been in and out of hospitals for years. In 2010, i went in front of a judge with my lawyer to get social security disability and i got denied, but the judge still gave me the back pay. He also said that he would leave the case open for a year just in case if i get sick again.

So basiclly the judge said that i was disabled for the two yrs that i had to wait to go before him. But the fact of the matter is that during that time i decided to go to college and the judge thought that i was ok. A year later i fell into a deep depression and i had to withdrawl from school. I have been suffering and all i wanted to do was get better with the help of social security. I take my meds, tried to work jobs, but its not working. Im 28 Now, lost 60 lbs while working, and i just need some advice on if i should try again for social security disability. Oh, im in college for psychology and im really smart, but i could use the extra help to focus on getting better and finishing school. I have also developed a extreme porn addiction and a cocaine addiction that im seeking help for.

By all means file again. What he meant by that one year thing, was really only that social security will only pay retroactive (back months) one year of benefits from the date that you file a new claim.

You don't have to pay money to file, so there is no risk. You only have to pay, if you get an attorney to represent you, and they would take 25% of your past due benefits.

I certainly would file again and hope you are still within the one year limit he is keeping the case open.

I would recommend trying again but discussing it with an attorney. Most attorneys work on a contingency basis and there is a cap on how much they can be paid in a disability claim (max is around $5000). Most work on a percentage basis as well so even if their percentage would equal more than $5000 they could only accept up to the $5000. An attorney can be very helpful with all the paperwork and helping prepare you for court, dealing with the appeals process, etc...
