| The good news and the bad news
Ok....good news first.I actually managed to wriggle into a t-shirt for the first time since the accident in November.May seem like a small triumph but I am a t-shirt and jeans kinda girl The bad news...maybe...I'm not gonna freak...yet.Just talked to a claims adjuster about my bike.The damage except for paint is minor so I had not been too concerned.But this guy says depending on the estimate for the paint they might write the bike off as a total loss.He says if that's the case then they take the bike and write me a check.And I'm thinking "Wait a minute pal,you can't take my bike!!!" I was sure I had repacement cost insurance but now they are saying it's actual cash value I'm trying real hard to have faith that this is gonna work out ok. phoenix |

A program friend of mine just had his FatBoy totaled by the insurance company. However, by accepting payment at $3000 less than what they would have paid for the bike, he gets to keep his bike, and walk away with enough cash to make the repairs. Maybe you could work out a similar deal? Also, the one time I had to deal with an insurance company about my bike (and related injuries) I got a motorcycle-friendly attorney to help me protect myself from the insurance company's vultures. Damned glad I did! He got me good money for the damage to my shovelhead, and made sure all my medical needs and attendant costs were taken care of. Yes, I paid him some money, but every cent was well-spent, IMHO. If you haven't got an attorney yet, perhaps you should consider it. We have a couple here in Texas who advertise in the local biker magazines. I'm sure your state has some, too.

Good for you .. don't panic.. no reason too you may have to "arbitrate" with them some. I can relate.. worst damage to my bike was the ding in the front fender and the crash bar .. my estimate was for $6300 and I knew that I could haggle for parts and do the labor myself and be able to afford the repaint and stuff I couldn't do. The adjuster told me that he found a bike just like mine on the net so he was gonna total it. I told him i had receipts for $17,000 and if he wanted to total it for that, he could come take everything in my garage that said Harley Davidson on it. He started to give me an argument and I hung up on him. I went on the net and found some links to customs for sale and emailed him. He called me back and said with the minor adjustments he had made to the estimate I could expect the check to be mailed to the shop and to go ahead and tel them to start the work. I told him I was doing the work and I wanted the check. More bs so I hung up again.. Called the painter and got him to give me an estimate, along with a welder, then faxed them to the agent. By this time he realized I was jusy trying to get back what rolled out of my garage that morning and he called and told me I could expect the check made out to me, just not to expect anything more if there was an over run on the cost by doing it myself. You paid for insurance to repair damage to your bike or replace it if it was invloved in an accident. It's your choice, the only thing they can argue is the $$ and if you can provide the documentation to show them wher your saving them in the long run they will back down. |

Congrats on the progress with your shoulder. I hear ya about the jeans and t-shirts. My preferred attire too... Good luck with the ins. co. Got no advice, just positive thoughts a comin your way that it all turns out ok for ya.

Phoenix! Glad your shoulder is on the mend and you can now ~~wriggle~~~. Oh man on the bike.. had the same with my car, I just wanted it fixed! But nope, they forked over a minimal check which couldn't come close to buying me another mustang! Prayers coming your way for positive results! |

Thanks everyone.I have an attorney for the medical issues and I will ask his advice on this as well.I also have some friends who will be doing some of the work,and the painter says he will find out what the other damage is costing and work his estimate around that.So hopefully all will be well but this sure has been an eye opener I go to the bone guy on the 21st and hopefully all the news will be good phoenix |

Phoenix, been in the crazy ins biz for many many yrs, not as an adjuster tho'. As a general rule of thumb, an ins. co. will total out any vehicle when the repairs reach 75% of the actual cash value. Translation........what it's worth today. Look around, and do your homework re: the value. Ask them how they determinded the value they came up with. Also, when an ins co does total it out, you should be able to buy it back for "salvage"......ask what they have in mind. Tom FLHRCI

yeah, the pot is always on. ya'll can come and watch my new pig buddy fly around the room. i'm still waiting on ins meself. been 3 years and some change now. just got another letter, another drs appointment plus, they set my income really low, cause i am usually cash and carry. the only way i can up what the settlement will be is to declare ALL my damn income, which might cost me more than ill get. who says what goes around dont come around. ha ha ha |
